Terms of Service

1. Acceptance of terms

By purchasing a key, installing the Jerboa Connect Discord bot, or otherwise using the Jerboa Connect service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms form a binding agreement between you and Jerboa Labs, LLC, a Washington state limited liability company ("we," "us," or "our").

2. Eligibility

You must be at least 13 years old to use the Service. If you are located in the European Economic Area or the United Kingdom, you must be at least 16 years old. By using the Service, you represent that you meet the applicable age requirement for your jurisdiction. You must also have a valid Discord account in good standing.

3. Keys and server registrations

Each key purchased entitles you to register one (1) game server. A single key may not be used to register more than one server. Using a key across multiple server registrations is a violation of these Terms.

Keys are non-transferable. You may not sell, share, gift, or otherwise transfer your key to another person.

Server registrations are tied to the original purchaser and may not be reassigned following a transfer of server ownership without our written approval. Contact us at legal@jerboa.gg if you need to request a reassignment.

Except where required by law, all purchases are final and non-refundable. We may, at our sole discretion, provide refunds, credits, or replacements in individual cases. If you experience an issue with your key, reach out in our support Discord.

EU/UK consumers — right of withdrawal. If you are a consumer located in the European Economic Area or the United Kingdom, you have the right to withdraw from your purchase within 14 days of completing the transaction, without giving any reason. To exercise this right, contact us at legal@jerboa.gg before the 14-day period expires. However, by purchasing a key and using it to register a server, you explicitly request that we begin performing the Service immediately; if you have already redeemed your key, you acknowledge that your right of withdrawal is lost in accordance with applicable law.

4. Permitted use

You may use the Service to manage game servers that you own or for which you have explicit authorization from the server owner to perform administrative actions. You are responsible for ensuring you have the right to administer any server you register with Jerboa Connect.

You are responsible for maintaining the security of your Discord account and any credentials used to access the Service. We are not liable for any loss or damage arising from unauthorized access to your account.

5. License grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service. We may revoke this license if you violate these Terms.

6. Prohibited uses

You may not use the Service to:

• Register or administer a game server you do not own or do not have authorization to manage.
• Use a single key to register more than one server.
• Transfer, sell, or share your key with any other person.
• Harass, harm, or discriminate against players or other users.
• Violate any applicable law or regulation.
• Interfere with or disrupt the Service, its servers, or its networks.
• Attempt to reverse engineer, decompile, or otherwise extract source code from the Service.
• Use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service.

We reserve the right to suspend or terminate access to the Service for any violation of these Terms.

7. Support

We are not obligated to provide maintenance, updates, support, or technical assistance, although we may choose to do so. Any support provided is offered at our discretion and does not create an ongoing obligation.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY WASHINGTON LAW AND OTHER APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or available at any particular time. We do not warrant that commands sent through the Service will be successfully executed by your game server.

Nothing in these Terms limits or excludes any statutory rights or guarantees you may have under mandatory consumer protection laws in your jurisdiction that cannot be waived by contract, including rights under EU or UK consumer law.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY WASHINGTON LAW AND OTHER APPLICABLE LAW, IN NO EVENT SHALL JERBOA LABS, LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND REPRESENTATIVES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:

• Loss of data, revenue, or profits.
• Unauthorized access to or compromise of your game server, RCON port, or credentials.
• Actions taken on your game server by Discord users you have granted permissions to.
• Service interruptions, downtime, or failures of third-party services (including Discord, Stripe, and cloud providers).
• Any damages resulting from commands executed through the bot, whether intentional or unintentional.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR KEY.

You are solely responsible for securing your RCON port, managing who has access to bot commands in your Discord server, and maintaining appropriate access controls on your game server.

Nothing in this section limits our liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any other liability that cannot be excluded or limited under mandatory applicable law, including mandatory consumer protection rights under EU or UK law.

10. Intellectual property

The Service, including all software, code, trademarks, logos, and content, is owned by Jerboa Labs, LLC and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service.

11. Indemnification

You agree to defend, indemnify, and hold harmless Jerboa Labs, LLC and its members, managers, employees, contractors, agents, affiliates, and representatives from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, available at jerboa.gg/privacy, which is incorporated into these Terms by reference. By using the Service, you agree to the collection and use of your information as described in the Privacy Policy.

13. Third-party services

The Service integrates with Discord and Stripe. Your use of those platforms is governed by their respective terms of service and privacy policies. We are not responsible for the actions, availability, or policies of any third-party service.

14. Termination

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice, including changes to features, supported games, pricing, registration limits, or any other functionality. We are not liable to you or any third party for any such modification, suspension, or discontinuation.

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Service. Upon termination, your server registrations will no longer function.

We reserve the right to investigate violations of these Terms and take any action we deem appropriate.

Sections relating to disclaimers, limitations of liability, indemnification, governing law, and any other provisions that by their nature should survive termination shall survive termination.

15. Force majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including internet outages, cloud provider failures, natural disasters, acts of government, labor disputes, or cyberattacks.

16. Governing law

These Terms are governed by the laws of the State of Washington, without regard to its conflict of law provisions.

If you are a consumer located in the European Economic Area or the United Kingdom, the choice of Washington law does not deprive you of the mandatory consumer protection provisions of the law of your country of residence. Those mandatory protections apply regardless of the governing law chosen here.

17. Dispute resolution and arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

EU/UK consumers — this section does not apply to you. If you are a consumer located in the European Economic Area or the United Kingdom, the arbitration requirement and class action waiver below do not apply to you. You retain the right to bring claims before the courts of your country of residence. You may also use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr to resolve disputes. Our contact for ODR purposes is legal@jerboa.gg.

For all other users: any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration shall take place in Washington state, or at your election, by telephone or videoconference.

Class action waiver. To the extent permitted by applicable law, you agree that any dispute will be resolved solely on an individual basis and not as a class action, collective action, or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Exceptions. Either party may seek injunctive or other equitable relief in a court of competent jurisdiction in Washington state to prevent irreparable harm pending arbitration. Small claims court actions within applicable jurisdictional limits are also exempt from this arbitration requirement.

Opt-out. You may opt out of this arbitration agreement by contacting us at legal@jerboa.gg within 30 days of first purchasing a key for the Service. Your opt-out must include your name, sufficient information to identify your Discord account (such as your username or user ID), and a clear statement that you wish to opt out of arbitration.

18. Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or operation of law. Any attempted assignment in violation of this section is void.

19. Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Jerboa Labs, LLC regarding the Service and supersede any prior agreements, representations, or understandings relating to the Service, whether written or oral.

20. Notices

Legal notices to Jerboa Labs, LLC must be sent to legal@jerboa.gg. We may provide notices to you through the Service, Discord, email, or by posting them on our website at jerboa.gg.

21. Severability

If any provision of these Terms is found unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

22. Changes to these terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

Changes to Section 17 (Dispute Resolution and Arbitration) will not apply to disputes for which a party has already provided written notice before the changes become effective.
